Welcome to HibanaPay brought to you by Velo Payments Ltd – you are likely seeing these terms because you have been presented with a QR code requesting payment from a HibanaPay user. These terms give you key information about using HibanaPay to make a payment, including who is responsible for your transaction.
Who we are, what we do and how to contact us
Velo Payments is operated by Velo Payments Limited, registered in England and Wales under company number 10613628 and have our registered office at Suite 1 3rd Floor 11-12 St James's Square, London, SW1Y 4LB (‘We’ or ‘Velo’).

We provide a mobile and web-based solution to offer Open Banking services that allows you to receive payments, pay or move money between accounts that you connect via the Hibana Pay platform. We partner with Yapily LTD API to connect your payments pursuant to the Payment services (PSD 2) - Directive (EU) 2015/2366. We utilize Yapily services for payment transactions operated through our website or app, using Yapily Connect Ltd, which is authorized and regulated by the Financial Conduct Authority under number 827001.
By making a payment, you accept these terms and consent to Open Banking
By making a payment using HibanaPay, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not proceed to make a payment.
As with all Open Banking provisions you must give your consent to make payments by providing your credentials to your bank through which you will make the payment.
HibanaPay is currently free of charge
By making a payment through one of our QR codes, you will not be charged any additional fee – other than the amount the HibanaPay user is requesting. If the HibanaPay user is representing that they must charge an additional amount for you to pay through HibanaPay, this is the vendors decision, not HibanaPay’s.
We are not responsible for other websites/links
We are only responsible for the QR code you have been presented with, as well as the link to these terms. Any other links shown to you, including, if applicable, the merchant’s privacy notice, are not approved by us. We have no control over the contents of any other sites, links or resources.
We are not responsible for your transaction
Whilst payments are facilitated through HibanaPay QR codes, Hibana ay and/or Velo do not process any payments. We operate the QR code payment structure through the use of Open Banking and Yapily (further details on Yapily and Open Banking can be found https://www.yapily.com/legal/yapilyconnect-terms-and-conditions/.) All payment transactions are processed using your own banking app.
If, for example, your transaction is declined or you experience another issue, such as duplicate or fraudulent transactions, please contact your bank immediately.
Whether you are a consumer or a business user:
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
If you are a business user:
We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with (i) use of, or inability to use, our service; or (ii) use of or reliance on any HibanaPay and/or Velo content.
In particular, we will not be liable for: (i) loss of profits, sales, business, or revenue; (ii) business interruption; (iii) loss of anticipated savings; (iv) loss of business opportunity, goodwill or reputation; or (v) any indirect or consequential loss or damage.
If you are a consumer user:
We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
If our QR codes damages a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill in supplying our payment service, we will pay you compensation.
Your personal information
If required by the third party from who you are buying goods or services, we may collect personal data. This data is stored by us and is made available to the third party. Under GDPR the third party is acting as the Data Controller and we are acting as the Data Processor. Please refer to the third party’s T&C’s for details of their use of personal data. Please also refer to our Privacy Policy.
At no point during the payment process do we hold, retain or utilize your bank login credentials.

Which country's laws apply to any disputes?
If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
